CONTRACT-OFFER
1. General Provisions
1.1. This Agreement is an official offer (public offer) by Sole Proprietor Semyon Alexandrovich Kondeev (hereinafter referred to as the "Contractor") to any fully capable individual or legal entity (hereinafter referred to as the "Customer") that accepts this offer under the terms specified below.
1.2. In accordance with Clause 2 of Article 437 of the Civil Code of the Russian Federation, upon acceptance of the terms below and payment for the services, the individual or legal entity accepting this offer becomes the Customer (as per Clause 3 of Article 438 of the Civil Code of the Russian Federation, the acceptance of the offer is equivalent to the conclusion of a contract under the terms of the offer).
1.3. The moment of full and unconditional acceptance of the Contractor’s offer to conclude this Agreement (acceptance of the offer) is the act of confirming the intention to pay for the Contractor’s services by clicking the "Pay" button on the website getmotion.online.
1.4. By accepting this Agreement in the manner defined in Clause 1.3, the Customer confirms that they have read, understood, and fully accept all terms of this Agreement, including its appendices, which form an integral part of it.
1.5. Acceptance of the offer constitutes the conclusion of a contract under the terms outlined herein.
1.6. The Agreement does not require signatures from the Customer or the Contractor and remains legally binding without them.
2. Subject of the Agreement
2.1. The Contractor provides motion design services (2D/3D animation) based on templates available on the website getmotion.online.
2.2. The Customer fully accepts the terms of the Agreement and pays for the Contractor's services in accordance with its conditions.
3. Payment for Services
3.1. The cost of services is specified on the website getmotion.online.
3.2. Payment is made through a third-party payment service; the Contractor does not store or process the Customer's payment data.
3.3. The Contractor has the right to change the cost of services unilaterally without prior notice to the Customer.
4. Service Procedure and Revisions

5.1. All text, graphic, and animated content published on getmotion.online is the intellectual property of the Contractor.
5.2. The Customer receives a non-exclusive, limited right to use the created content (including videos and animations) for commercial and/or personal purposes, without the right to resell or modify it, unless otherwise stated in this agreement.
5.3. The Customer has the right to use the created content at their discretion, including in advertising materials, websites, and social media, but is not entitled to transfer or resell the original content to third parties.
5.4. The Contractor is not responsible for any consequences of the Customer’s use of the content, including but not limited to violations of copyright, laws, or terms of use, or any damages resulting from content usage.
5.5. If the Customer makes any modifications to the content, including but not limited to edits of videos, animations, or other elements, the Customer assumes full responsibility for the legality of such changes and their compliance with the laws of the Russian Federation. The Contractor is not liable for any consequences, including possible violations of third-party rights.
6. Liability of the Parties
6.1. The Contractor is responsible for the timely provision of services, provided that the Customer fulfills the requirements stated on the website getmotion.online.
6.2. The Contractor is not liable for delays caused by factors beyond their control (including force majeure).
6.3. The Contractor is not responsible for failures in the operation of payment systems and internet providers.
7. Confidentiality and Personal Data Protection
7.1. The Contractor agrees not to disclose any information received from the Customer.
7.2. Disclosure of information in accordance with Russian Federation law is not considered a violation.
7.3. The Customer’s personal data is processed in accordance with the Privacy Policy published on getmotion.online.
8. Dispute Resolution
8.1. All disputes and disagreements arising in the course of performance of this Agreement shall be resolved through negotiations between the Parties.
8.2. If the dispute cannot be settled through negotiations, either Party may refer the matter to a court at the location of the Contractor’s registration.
9. Refund Policy
9.1. Refunds are only possible if the Customer cancels the service before the development of the 3D model has begun. The start of development is considered the commencement of work on the 3D model, confirmed by notification to the Customer by any means, including messengers or email.
9.2. If the Customer has selected additional services, the payment amount increases, but the addition of services does not affect the possibility of partial cancellation. Cancellation is only possible before the model development begins.
9.3. Refunds are granted under the following conditions:
10. Other Provisions
10.1. The Customer has all necessary rights and authority to enter into this Agreement.
10.2. The Contractor reserves the right to change or supplement the terms of this Agreement at any time by publishing a new version on getmotion.online.
10.3. The Customer may cancel services at any time; however, refunds for paid but unused services are only possible as outlined in the Contractor’s refund policy.

4. Service Procedure and Revisions
4.1. The motion design service includes:
- Selection of a template by the Customer on the website getmotion.online,
- Creation of a custom 3D model of the Customer’s product,
- Integration of the 3D model into the selected template and final rendering.
- 4.2. After the 3D model is created, the Customer is provided with one stage of approval, during which they may submit one list of corrections regarding the appearance and textures of the model.
- 4.3. After the 3D model is approved, no further changes are allowed to the visual part, including the template, script, animation, or video structure.
- 4.3.1. If the Customer has chosen the basic option, they may submit corrections to the model’s appearance only once. Color adjustments are not permitted.
- 4.3.2. If the Customer has selected the visual color change option, they are entitled to make one set of corrections regarding both the model’s appearance and its color. No further changes are allowed unless otherwise specified in an additional agreement with extra payment.
- 4.4. The final stage of the service is the delivery of the finished video file to the Customer. From that moment, the Contractor's obligations are considered fulfilled.
- 4.5. Re-creation or revision of the 3D model, as well as video editing, is only possible for an additional fee based on a supplementary agreement.
5.1. All text, graphic, and animated content published on getmotion.online is the intellectual property of the Contractor.

9.2. If the Customer has selected additional services, the payment amount increases, but the addition of services does not affect the possibility of partial cancellation. Cancellation is only possible before the model development begins.
9.3. Refunds are granted under the following conditions:
- Within 2 days from the payment date, if the 3D model has not been approved and development has not started – a 100% refund is possible.
- After 2 days from the payment date or once development of the 3D model has begun (regardless of whether the model is approved), no refund is possible. The start of development is confirmed by delivery of the initial drafts or materials to the Customer.
- 9.4. If the 3D model has been approved, no refund is possible, regardless of the time elapsed since payment.
10. Other Provisions
10.1. The Customer has all necessary rights and authority to enter into this Agreement.
10.2. The Contractor reserves the right to change or supplement the terms of this Agreement at any time by publishing a new version on getmotion.online.
10.3. The Customer may cancel services at any time; however, refunds for paid but unused services are only possible as outlined in the Contractor’s refund policy.
